3M Earplug Lawsuit

Veterans who served in the military between 2003 and 2015 may be entitled to compensation in a 3M earplug lawsuit. Since discovering that 3M marketed defective earplugs to the military, law firms across the United States have experienced an influx of calls from veterans and their families.

Law firms receiving these inquiries must be prepared to manage more than just a higher-than-average call volume. They must also be knowledgeable on the details of 3M earplug lawsuits, eligibility, damages, and how to qualify potential leads.

Many law firms are turning to Legal Conversion Center to assist them in managing 3M earplug lawsuit inquiries. At LCC, we offer intake support for law firms that includes generating leads, qualifying leads, acquiring retainers, and assisting with contract management. Our goal is to provide intake support for law firms so the attorneys can focus on their clients.

Who is Eligible for a 3M Earplugs Lawsuit Payout?

At LCC, we are committed to serving the men and women of the U.S. military. Part of that commitment is assisting law firms who fight for the rights of injured veterans. With more than 220,000 lawsuits already filed against 3M, there is a great likelihood of significant payouts once these cases are resolved. Veterans who meet the qualifying criteria for a 3M lawsuit and have verified injuries as a result of the defective earplugs may be eligible for such a payout.

Currently, numerous lawsuits have been consolidated into multidistrict litigation, or MDL. MDL is a streamlined process that places all 3M earplug lawsuits into the same court for review. The first MDL trials are underway in what is being called one of the largest MDL cases in U.S. history.

3M Earplug Lawsuit Criteria

Part of LCC’s commitment to our law firm partners is providing meticulous intake services to qualify every potential new client. Our team will carefully vet each lead to ensure that they meet the following qualifying criteria:

  • Veteran who served in the U.S. military between 2003 and 2015.
  • Served in active combat.
  • Used 3M Combat Arms dual-ended earplugs during service.
  • Have been diagnosed with tinnitus or hearing loss within two years of discharge.
  • Have been honorably discharged, or still in service.

What Earplugs Were Involved in the Lawsuits?

The earplugs involved in this massive litigation are 3M dual-ended Combat Arms earplugs (CAEv2). These earplugs were sold to the U.S. military under a massive contract with the U.S. Department of Defense. After thousands of the earplugs had been issued to servicemembers, it became known that they were defective. 3M admitted that they knew the earplugs were defective but did nothing to mitigate the risk to active duty soldiers. 3M never recalled the defective earplugs but did stop selling them in 2015.

In July 2019, the United States Department of Justice settled a lawsuit with 3M over allegations that the company defrauded the government. The allegations relate to military-grade earplugs that were sold to the military over a period of years. They are designed for military use with dual ends designed to:

  1. One side block loud or explosive noises, while allowing the wearer to still hear conversational sounds.
  2. The other end blocks all noise.

Instead of working as intended, the earplug connection stem was too short, which allowed the earplugs to move around inside the ear unbeknownst to the wearer. The loosened earplugs did not provide adequate protection, which resulted in significant harm.

What Damage Did the 3M Dual-Ended Earplugs Cause?

Since it was made known that the 3M earplugs were defective, a variety of injuries have been reported by veterans who used them in combat. Currently, lawsuits list the following injuries and damage:

  • Tinnitus (intermittent or constant ringing or buzzing in the ear)
  • Dizziness or vertigo
  • Headaches, neck aches, and ear pain
  • Partial hearing loss in one or both ears
  • Complete hearing loss in one or both ears
  • Inability to sleep
  • Irritability
  • Anxiety

All of these conditions and the related psychological impact are significant. The damage also often extends beyond the victim to his or her family members as well.
